Bovis, Kyle & Burch, LLC's insurance litigation department is actively involved in all facets of environmental law. Uniquely, the firm has an active practice not only in coverage matters, but also in the defense of insureds and self-insured corporations in toxic tort liability situations. Throughout the southeast the firm prosecutes declaratory judgment actions on behalf of insurers, and defends declaratory actions when filed by the insureds. The firm routinely represents primary carriers, as well as excess carriers, and is involved with ancient as well as current policies and those with and without pollution exclusions.

On the liability side, the firm defends personal injury, wrongful death, business interruption and property damage cases arising out of the discharge of contaminants and pollutants. Members of the firm have for many years been involved in numerous cases involving underground storage tanks, above-ground chemical spills, manufacturing contamination of soil, air and groundwater, fish kills, paraquat over sprays and other facets of the use of herbicides and pesticides, as well as Wetlands Act problems. The firm, also has experience handling mass toxic tort claims from plants emitting silica dust.
