Bovis, Kyle & Burch Offices Dress Down and Donate for Halloween 2012

In an effort to support a valuable client and a worthwhile charitable organization, Bovis, Kyle & Burch (BKB) employees were given the opportunity to wear jeans to work on Halloween if they made a donation to The Salvation Army. The BKB attorneys and staff were excited to dress down for the day and donate in order to support The Salvation Army initiatives, which currently include relief efforts relative to the damage caused by Hurricane Sandy on the East coast of the US earlier this week. Bovis, Kyle & Burch Expands Family Law Practice

On August 15, 2012, Bovis, Kyle & Burch was featured in the Daily Report for the expansion of the firm's Family Law practice.  The firm added new partner, Erin Stone, and two new associates, Winfield Pollidore and Erica Byrd. In the article, Stone states that her attraction to Bovis, Kyle & Burch was the firm's growth in its Family Law practice, as well as her ability to draw on expertise from the firm's general practice groups. Pollidore, previously an IP and patent attorney, turned his talents to family law when he met Stone at a domestic relations mediation training and has practiced family law with her since. Byrd, who clerked for Bovis, Kyle & Burch, interned for the DeKalb County Child Advocacy Center and was a law clerk for DeKalb County Superior Court Judge Gregory Williams. BKB Partner, Greg Presmanes speaks at State Board of Workers' Compensation 2012 Regional Education Series

Bovis, Kyle & Burch partner, Greg Presmanes, is one of the speakers for the State Board of Workers' Compensation 2012 Regional Education Series entitled "Your Backstage Pass to Workers' Compensation", which covers topics such as Legislative & Case Law Updates, Could This Accident be a Compensable Injury, Pain Management, and Perspectives from the Bench.  The series was presented in Newnan, GA at The Centre for Performing & Visual Arts on April 12, 2012, and was presented in Lawrenceville at the Gwinnett Technical College on April 19, 2012;  in Macon at Macon State College on April 26, 2012; and in Savannah at Coastal Georgia Center on May 10, 2012.  At each location, the Honorable Richard Thompson, Chairman of the Georgia State Board of Workers' Compensation is speaking on the State of the Board, and the Honorable Melodie Belcher and her panel are presenting "Perspectives from the Bench: Georgia's Evolving Workers' Compensation System".  Mr. Presmanes' topic is "Could This Accident Be a Compensable Injury?".

Jack Burch, Christina Craddock and Tim Burson to Present Seminar Topics at Surety & Fidelity Seminar

Jack Burch, Christina Craddock and Tim Burson will be among the featured speakers at the 23rd Annual Southern Surety & Fidelity Claims Conference, April 18-20, 2012 in Clearwater, Florida.  Christina is presenting with Capitol Insurance Company's Ron Wills and is addressing fraud and misrepresentation and the impact of such on bond claims.  Jack Burch is joined by Chubb & Sons Insurance Group's Christine Romeo and is discussing cutting edge strategies for bond claim professionals.  Tim Burson and Liberty Mutual's Judith Bufler will be speaking about the effect of Statutes of Descent and Distribution on commercial probate bonds for administrators and personal representatives.  The Southern Surety and Fidelity Claims Conference is an annual gathering of Surety Bond and Fidelity Claims Professionals and Attorneys from across the United States to discuss and review important developments and strategies used in responding to surety bond and fidelity insurance loss claims and issues.

BKB Attorney to Speak at Property Loss Research Bureau National Conference in April, 2012

Scott Busby, a partner at Bovis, Kyle & Burch, LLC, has been asked to speak at the Property Loss Research Bureau National Conference.  The conference is being held April 15-18, 2012 in Orlando, Florida.  Scott will be speaking on Extra Expense Coverage Issues.

Tim Burson Wins Appeal Affirmation of Judgment for Surety and Fee Award

On March 13, 2012 the Georgia Court of Appeals affirmed a judgment obtained by Tim Burson for Western Surety Company defeating a claim by two adult heirs against a $310,000 bond for alleged waste, mismanagement and self dealing by a bonded conservator.   In Re Estate of Clorina Haring.  A11A2282, ___Ga. App.____, _____SE.2d______(March 13, 2012).   The Probate Court suit for accounting, and bond surcharge was brought by two adult heirs--one as Executor against a caretaker Conservator (and his Surety) of their mother.  The Conservator had paid an unlicensed caretaker and himself at least $222,690.02 for the supervision of the Ward for more than 5 years after she had been diagnosed with Alzheimer's and declared incompetent.  The payments had been made without express prior or subsequent approval by the Probate Court.  Through Mr. Burson, the Surety successfully persuaded the Probate Court (in the face of the claimant's contrary expert testimony) that a licensed care-facility or licensed caretaker could not have reasonably cared for the Ward for less costs than the amounts charged by the unlicensed caretaker and the bonded Conservator and moreover could not have cared for the Ward with the love and attention she actually received.  The Surety's defense strategy was premised upon the facts that the bonded Conservator--who had lived with the Ward for more than 32 years though the two were never formally married--treated the Ward with more love and affection than she could ever receive in a licensed facility and that the costs incurred were significantly less than the amount a licensed facility would have charged for this particular non-ambulatory, non-communicative Ward--who required supervision and attention 24 hours every day.  The Court of Appeals upheld the entirety of the Probate Court judgment including an award of attorneys' fees and expenses in favor of the Surety and against the Ward's executor heir and his sibling.

Two Bovis, Kyle & Burch, LLC (BKB) attorneys have been named “Rising Stars” in Georgia in the 2012 Super Lawyers selection process.

Super Lawyer “Rising Stars” are chosen through independent research and peer nominations.  “Rising Stars” must either be 40 years old or younger or in practice for 10 years or less.  No more than 2.5% of lawyers in the state are named to this prestigious honor.  The BKB attorneys selected as “Rising Stars” in 2012 are:

BKB Family Law Significant Custody Win for Father

Father and Mother with a 1 year old son had decided to divorce. One month after they "discussed" divorce, Mother told Father they were "now" divorced. Father could not understand how they could be divorced when he had never seen a Complaint for Divorce, was never served, never signed any documents, and never attended any Court hearings. Father went to his County to retrieve the record and saw that his name had been forged to all divorce pleadings. Father saw that Mother had obtained custody for herself of the minor child, had obtained an Order of child support for Father to pay (which Father did not even know about) and had obtained an Order in which Father was to pay all marital debt.  Father hired Attorney Marilyn Kapaun from BKB Family Law to overturn the divorce and then represent him in a valid divorce action in which Father sought custody of the minor child. BKB served Mother with a Motion to Set Aside the Divorce Decree, and Mother absconded to another state with the minor child. Our firm represented Father at an Emergency Hearing where the Judge ordered the Mother to return the child to the jurisdiction under penalty of incarceration pursuant to our Emergency Order. We represented Father regarding the Set Aside of the original divorce decree. Attorney Kapaun obtained an Order in which Mother was found to have signed Father's name to all pleadings and this was submitted to the local police to pursue Mother criminally for forgery and fraud. The original divorce was set aside. Attorney Kapaun represented Father at two probable cause hearings against the Mother for forgery and fraud, and the Municipal found probable cause to arrest Mother for forgery in the first degree, a felony. Mother was arrested a second time. Attorney Kapaun represented Father in the new divorce action and prevailed in obtaining custody for this Father.

BKB Attorneys Judge 2011 Emory Moot Court Society's Civil Rights and Liberties

Attorneys Charles Medlin and Marilyn Bardie-Kapaun judged the 2011 Emory Moot Court Society's Civil Rights and Liberties Competition held at Emory School of Law October 14-16, 2011. Thirty two law schools from across the country competed in this year's event.
