Cobb County, GA – In Cobb County State Court, a jury awarded no recovery to a plaintiff who claimed over $106,000.00 in past medical expenses following a minor fender bender. Partner Wayne Tartline led the defense, joined by Associate Matthew Spencer and Summer Associate Jack Chenette. The verdict marks a decisive win for the defense and underscores the importance of truthfulness and candor in the courtroom.
The case arose from a low-speed collision in August 2022. The plaintiff later claimed severe neck, mid-back, and lower back pain. The plaintiff presented extensive medical records documenting treatment, including multiple MRIs, chiropractic treatment and physical therapy. Of the substantial medical bills, approximately $70,000 related to multiple spinal injections and a lumbar surgical procedure performed by a prominent Atlanta orthopedic practice.
The defense team’s diligence uncovered crucial documents that became relevant and admissible when the plaintiff downplayed his prior spinal injuries and “did not recall” his previous personal injury claim. Tartline successfully impeached this testimony and introduced the key documents into evidence, ultimately severely undermining the plaintiff’s credibility.
In closing arguments, Tartline brought the evidence together with a clear and compelling message—truth is easy, and the plaintiff’s deception should not be rewarded. The jury returned a complete defense verdict, highlighting how thorough preparation, effective advocacy, and honesty with the court are essential to securing a fair and just result.
