Family Law

At Bovis, Kyle, Burch & Medlin, LLC, we offer our clients the broad support needed in most all areas of family law including divorce, custody litigation, property division, and prenuptial agreements. We are able to help clients with contested and uncontested divorces, and we assist and guide clients through the difficult and troubled waters of custody cases and complex business and property division sometimes involved in divorces. We also have the resources of corporate attorneys capable of providing guidance in the division of stock ownership, business interests, and partnership issues which are encountered by our clients.

Our senior Family Law partner, Charles McCall Medlin, an honor graduate of Duke University and an honor graduate of the University of North Carolina at Chapel Hill, heads the family law division of the firm. He was awarded the highest rating "Av" in the Martindale Hubbell Law Directory and was inducted into "Who's Who of American Lawyers" in 1994 and in 2014 was nationally ranked in the “Top Ten” by the National Academy of Family Law Attorneys.

Erin S. Stone is a Family Law partner at Bovis, Kyle, Burch & Medlin, LLC. She graduated cum laude from the University of Georgia School of Law. Erin has been honored for her work in family law with her selection as a Super Lawyer in the state of Georgia for multiple years. She has handled cases in all areas of family law including divorce, child custody, child support, alimony, division of property/debt and contempt. Erin is also a trained mediator.

Marilyn Bardie KapaunWinfield Pollidore, and, Lauren L. Barrett are other attorneys with the firm and members of the State Bar of Georgia, who also assist in guiding our clients through the maze of family law issues.

Our goal is to advise our clients of the law in Georgia as it relates to domestic relations while serving as their zealous advocate in courts throughout the state. We have also served as out of state counsel for clients facing prenuptial negotiations, divorces and/or custody contests in other jurisdictions in the United States and outside the United States. We have been engaged in bilingual domestic issues and successfully negotiated with attorneys and courts in other countries.

In custody cases, we provide quality representation for our domestic relations clients at fair rates while keeping in mind the best interests of children who are involved. Mr. Medlin is a certified Guardian Ad Litem and advises courts concerning the "best interests" of children in cases where he does not represent one of the parties. Many times, we have worked out settlements for our clients that allowed clients to escape a future of devastating litigation costs while putting their money into their children rather than fund years of legal costs. At times, lengthy litigation cannot be avoided due to various issues and other problems, and in those cases, we pledge to advocate boldly for our clients' positions within the bounds of the law while keeping in mind the possibility of settlement and mediation through Alternative Dispute Resolution (ADR) whenever possible. Charles Medlin is also a certified mediator who assists other attorneys in resolving their cases. 

Prior to entering marriage, we prepare prenuptial agreements for our clients wishing to enter a new marriage with a better foundation so that our clients can better avoid taking or assuming unnecessary risks in their new relationships. Full and fair disclosure is necessary in entering the agreements. Although prenuptial agreements are subject to attack later, we try to cover the important elements to maximize the likelihood of having agreements upheld. We frequently suggest to our clients issues to consider and potential solutions to problems that may not have been anticipated by the client. We also create our agreements with an eye toward the future. While Superior Court judges have the power to invalidate portions of agreements entered between spouses, at Bovis, Kyle, Burch & Medlin, LLC, we attempt to stay abreast of all legal changes so that future challenges may be minimized wherever possible.
